LE JARDIN ASSOCIATION

Terms of Use

Including the End-User License Agreement for the resident portal and Finance integration.

1. Website operator and scope

These Terms of Use and End-User License Agreement (“Terms”) govern use of the Le Jardin Association website, resident portal and Le Jardin Association Finance, operated by Le Jardin House Condominium Association, Inc. (“Association,” “we,” or “us”). By using the portal after these Terms are presented, you agree to use it in accordance with them. If you cannot agree, contact management for another way to request association services.

These Terms govern website use. They do not amend the condominium declaration, bylaws, approved rules, leases, ownership rights or applicable law. They do not create association membership, transfer property rights or authorize a new assessment or fee.

2. Access and limited license

We grant approved users a limited, nonexclusive, nontransferable permission to use the portal for lawful association business and services during their authorized access. Registration or email verification alone does not grant resident, owner, staff or administrative permissions. Access depends on verified roles and apartment assignments and may expire when a tenancy or staff role ends. Use your own approved account and keep your sign-in credentials and codes private.

3. Responsible use and submitted information

Provide accurate information and promptly report incorrect contact, occupancy or billing details. Upload information, images and documents only when you have authority to do so, including when acting for household members. You retain your rights in submitted material and permit the Association and its service providers to process, store and share it only as needed for the services and purposes described in the Privacy Policy.

Do not impersonate another person, share protected records without authority, misuse pickup codes, send unlawful or abusive content, upload malicious files, interfere with the service, bypass access controls, scrape private information or use the portal for unrelated advertising. Community content may be moderated. The Association may correct access permissions or suspend website access for security or misuse; contact management to request review. Website suspension does not remove statutory or contractual rights to association services or records.

4. Invoices, QuickBooks and payment information

Only authorized administrators may prepare and issue invoices or connect the Association’s QuickBooks company. They must review the issuer, payer, apartment, accounting mapping, amount, dates and recipient before sending. When configured and connected, the service exports issued invoices and reads QuickBooks balances. A draft is not an issued invoice; email delivery is not payment; a zero balance may reflect credits as well as cash. Review the last successful synchronization time and source record before acting on a balance.

The website’s accounting integration does not debit a bank account or charge a card. Payment instructions must be approved by the Association. Rent payments through Baselane are a separate landlord/tenant service governed by that provider and the rental agreement. Confirm unexpected changes in payment instructions with management using a known contact.

Amounts, due dates, grace periods and late fees must be supported by applicable association documents and law. The portal does not independently establish those obligations. Contact management promptly if an invoice appears incorrect or already paid. These Terms do not impose a new convenience fee, late fee or subscription.

5. Package collection and electronic receipts

Staff must check recognized label details, apartment assignment and recipient authority before completing package intake or collection. OCR and QR scanning can make mistakes. A QR code identifies a package; it is not by itself proof of authority to receive it.

When you sign and confirm a package receipt, the signature, package reference, time and staff record are retained as collection evidence and may be emailed or archived. Sign only for a package actually received by you or an authorized representative. This acknowledgement is not a waiver of unrelated rights or claims. Contact the concierge if you cannot use the electronic-signature process.

6. Notices, documents and assistance

The portal provides operational email and in-site notifications. Keep your contact details current and check spam folders. A “sent” status records provider acceptance, not proof that a message was read. A portal message or broadcast does not replace a legally required delivery method unless that method is separately authorized.

Document access is subject to the Association’s permissions and applicable rights. AI answers, OCR results and web research may be incomplete or incorrect; verify important information with source documents and authorized management. They do not constitute legal, tax or financial advice or a binding board decision. Do not use the portal for emergencies. Call 911 for an immediate threat to life or safety.

7. Connected services

Intuit, Google, Dropbox, Slack, OpenAI, Cloudflare, Baselane, WhatsApp and other linked providers operate their own services under their own terms and policies. A connection is active only after the necessary authorization and setup. Provider outages, revoked access or limits can delay processing. QuickBooks connection does not make Intuit the operator of this website or imply Intuit endorses the Association. Authorized account owners may revoke integrations; existing records may remain as described in the Privacy Policy.

8. Availability and responsibility

We use reasonable care to operate the portal, but do not guarantee uninterrupted access, error-free automated results or immediate synchronization. To the extent permitted by applicable law, the online service is provided as available without additional warranties. Nothing in these Terms excludes liability that cannot lawfully be excluded, excuses required association duties, or waives rights under condominium law, governing documents or a lease. Report errors promptly so the Association can investigate and arrange an alternative process when needed.

9. Ending access and changes

You may stop using the portal and ask management to review your account. Ending access or disconnecting a service does not cancel unpaid obligations, delete official records or erase third-party archives automatically. We may update these Terms by posting a revised effective date and providing notice of material changes through an appropriate portal or contact channel. Changes apply prospectively and remain subject to applicable law.

10. Contact and applicable law

For support, privacy requests, billing questions or concerns about these Terms, contact info@lejardin.house or Le Jardin House Condominium Association, Inc., 1150 102nd Street, Bay Harbor Islands, FL 33154, USA. Florida law and applicable United States federal law govern these Terms, subject to any mandatory rights or procedures that apply. These Terms do not require arbitration or waive a right to seek relief through an available lawful process.
